Attempted Copyright Infringement or Attempted Fraud
IANAL, but I think infringement only takes place when duplicating/distributing the works. Just having them sitting there is probably ok as long as you don't pass them on to anyone else.
Why don't you just avoid that situation and that uncertainty by executing a collaboration agreement between you before starting work?

Actually it takes place when you create the copy (hence copyright) regardless of if you distribute. Obviously if you copy something in secret and hide it under the bed your unlikely to get into trouble but it is still copyright infringement :)
