Actually, in the US, Verizon and Sprint are including GPS on all phones they sell now. They opted to use GPS to satisfy the Government's requirements. Most of the other major carriers in the US are using network based systems.

For all of the network-based systems, you will have to go through the carriers. Verizon and Sprint require in their terms that user locations are part of their network and under their control, but you may find a technical (not legal) way around this.

In Europe, GPS is only included on a very small percentage of total phones. However, many of the new smartphones have it imbedded.
