Axial Billboarding

As the title suggest, I would like to draw trees on a quad and make them always face the viewer. I tried something aldready,
	d3dDevice->GetTransform(D3DTS_VIEW, &pView);

	pView._41 = 0.0f;
	pView._42 = 0.0f;
	pView._43 = 0.0f;

	D3DXMatrixTranspose(&matBillboardView, &pView);

	d3dDevice->SetTransform(D3DTS_WORLD, &matBillboardView);
and that doesnt quite work when I'm looking up or down the tree texture seems to follow me. I want it of course to stick on the ground. Any ideas ?
