How do you figure?
Pretty simple logic. Its not his property, AOL has no rights to it. What if they don't find the gold? Can AOL dig up the neighbor's yard? Perhaps his ex-girlfriend has some of the gold buried in her yard?
For that matter, who's to say the gold they might find was his? Its not on his property. All the parents would have to say is that they buried gold back there years ago, and AOL couldn't touch it.

You lose rights when you commit crimes.
What crime did the parents commit such that they lose their rights?
If creating a loophole that nullifies future lawsuits guarentees my right against search by some private entity, then so be it.
