glScissor not usable with FBO?

On my ATI card I could use my shadow map which is a FBO with only a depth buffer attached. On the nVidia card garbage came out of shadowing. I then fiddeled around with the code and disabled once GL_SCISSOR_TEST and then it worked. So is this now a driver bug or is the Scissor-Test undefined on a FBO? The scissor box itself I have setup correctly using
glScissor( 0, 0, width, height );
with width=height=shadowMapSize Any ideas?
