Flaming Particle Collision

This would be difficult to explain, so I threw it all onto some images showing the problem. Hopefully showing it clearly. edit: In case it's unclear, in the 4th image, the spine is swooping up into the bottom of the object, and that results in all particles colliding with the plane as soon as they are born. Does it look like this is a decent solution? The particle curvature betweeen the spine nodes should always be minimal. So it's not likely they could start out behind the plane from the beginning of the intersect test. Any other ideas?
