Problem about ocean water ( ATI sample )

I'm working for hours to turn the sample from Dx8 into Dx9.
But something is still wrong....
I don't know if the sample can be turned into DirectX9, I tried , but failed.
D3DXAssembleShaderFromFile( "shaders\\OceanWater.vsh", 0, NULL, 0 , &pCode, NULL ) ;
because the function above never work right , always failed.
The OceanWater.vsh did exist.
if someone can help me turn it into directX9 ,
or offer me some water sample by DirectX9 simple enough,
I will be really appreciate!!!!
We really need this, after a week or two , our program will be checked by the teachers.
So anyone who can offer me something is welcome.
Take a look at NVidia's Ocean Waves sample. You need to open it with NVidia's FX Composer.
