fmod mp3 restriction clarification

Hello again, This question is in regards to mp3 usage. I have just got mp3 playback up and running under fmod. As stated on the fmod website I can use and distribute a program I create using fmod so long as I am not selling it. My question is in regards to the mp3 music. I have read somewhere (I believe on an online tutorial about ogg streaming) that the mp3 format has patents and restrictions. Am I allowed to redistribute my games music in this format without running into any problems? NOTE: I am not talking about music that would be considered ip infringement. I am talking about music that I have created. Is it ok to distrbute in this format or are there complications? It's probably a simple answer but I figure its better safe than sorry. Thanks in advance!
