Using photoshop , 3D Studio max

I'd strongly suggest try trial software. And pick the one in which it is best to work for you.

For example, I tried photoshop, although I just couldn't work comfortable with its gui, tools and such ... and so I'm using GIMP, because it is more comfortable for me (I saved $700 for Photoshop - because even if I bought it I'd rather use GIMP, because I just like more to work in it).

On the other hand I've been working in 3ds Max rather than in Blender (even though I now think of other variants like Maya - because I just need to work under linux currently) ... Blender is just ugly (its interface is really crap and I hate to work with it), I also thought of creating my own small editor (I have own texture mapper (and megatexture mapper) for example), because I use just 1% of all features there.

All I wanna say is try the software before you decide - and work in what you're comfortable with.

I assume you're talking to me. You are the one who opened the subject when you said, "Is the game on xbox Live or any indie game will get 700$ easily ?"
You are expecting to self-publish, are you? That is to say, to get your game hosted for you without going through a publisher? Please clarify your business thinking (what you are planning to do with the game once you make it).

It isn't cheap to get your game on XBLA. At the very minimum, you have to pay for a development kit (about $5k (or have they gotten cheaper now?)) and the costs to get your game through Microsoft's testing procedures.

Did you mean XLIG?

In that case, have you looked at the games/applications on XLIG that actually make money?

The focus of this thread seems to have changed, but on the original topic... as far as I know licenses for 3DS Max are non-transferable, meaning you can't legally buy a used copy of it. Once someone buys a copy they are the only one allowed to use it. I imagine Photoshop has similar restrictions.
I might be wrong, but I've heard that last cases from the USA shows that you can resell software according to the first-sale doctrine or something like that, no matter what a license says (such points are unenforcable). I suppose that a situation is similar in many other countries (software owners can not forbid you selling software that you have bought).
There is however other mechanism that hold used software market - most of them are using upgrade mechanism, so when a company wants new version of say Photoshop they would rather upgrade their old version (what is cheaper, but they can not sell it because they are still using it) instead of selling old version and buying new one. Thus there will be no or very few used versions of Photoshop that you could buy (even if you can legally do it).
