I think the key points to bear in mind from the points raised in this thread is that there are good grounds for taking you to court if you attempt that. They may lose, or they may win, depending on the exact details, the judge you get, etc. But I''m guessing you want to avoid that altogether, which means not using any trademarks and not reproducing any copyrighted material. (ie. give everything a different name and create your own graphical/audio assets.)
