Seems there's no such thing, basically I just need to get inspiration for an API (I will re-implement graphics in DX using 3D to prevent sorting problems etc.), probably I just need a minecraft like engine or a tile engine don't know still focusing an Idea. As long as I have a Good API to start from (I will credit the authors of course) I will start implementing that. I have no problems with programming / graphics, just wandering what would be a simple api to get started quickly creating a game after the engine

Maybe Unity with isometric camera view should do the thing? After all there are isometric games made with Unity ( for example Shadowrun Returns ).

If you are going to re-do it using 3D, then any 3D engine will work.  You just need to put the camera in an overhead perspective and possibly make it orthographic. Both Unity and Unreal, this is pretty easy, so was Havok's free engine, I think their starting demo was a diablo like.  Though I don't know what happened to that engine.
