Menu problem in a fullscreen DirectDraw program.

I have a program that has a regular menu like with the File/Edit stuff. The menu goes away when you start playing (SetMenu(hWnd, 0)) and it comes back when you pause (SetMenu(hWnd, hMenu)). The problem is that sometimes the menu doesn''t come back when you pause. It always comes back in windowed mode though. Do I have to release the surface or something?
