So the short of it is this: He wants to release it and point people to his website. Great. He may get a cease and desist. He wants to put it on GOG, iTunes, Marketplace, or App Store. Then he will get a cease and desist.

Outside of that, Vasenkov, good job, great idea, hope to see the game finished and released.

Predicting a legal takedown notice from Nintendo's Lawyers in 3... 2... 1...

Nintendo is extremely strict about protecting their IP. Mario by himself is worth roughly a bajillion Yen as the #1 most recognizable game character, and Yoshi is close behind as the #3 most recognizable game character.

Their legal department is aggressive both to take down sites and take other legal action against infringers.


Is this guy serious? Buddy, take your legal preaching to the thousands of other Mario fan games that both have more "recognition" than this fan game and are more infringing.
Yes, he's serious. The thousands of other Mario fan games are not posting here. Also, if he's infringing on IP, which he is, then it is absolutely within our rights (and I'd argue duty) to warn him of the consequences that may occur. Just because 150,000 people do something wrong and get away with it, does it mean: it's ok and no one should say anything about it.

With that said, as stated before, I like the game. It's well done.

My point is that there are far more Mario fan games out there than you can count, that have more recognition. In fact, they have enough recognition to be noticed by Nintendo and definitely warrant a takedown notice... yet absolutely nothing happened. This includes Super Mario Crossover, MKF and Abobo's Big Adventure.
I should point out that the game has a bug: stuck on the beginning of the second level. You're supposed to go down the pipe, but that doesn't work...
