leagle issues with using music in games

If i am makeing a game just for fun and learning purposes which will never be anything but freeware, Can I leagaly put copyrighted music into the game without any sort of permission from the owner of the music?
These tears..leave scars...as they run down my face.

Magnatunes is an online music "store" that lets you listen to all their songs, and buy or license them for your use.

They've a number of different licensing options, but for non-commercial use they allow you to download them for free.

Unfortunately, I havn't seen any mainstream music there, but there's some good stuff.
Short answer: AFAIK, it's not legal.

I've used one little image. I changed it a bit. See what happened? :-)
And it didn't matter to them that my game was freeware too.


Now imagine, that you've taken somebody's music. That person was working hard on it for... lets say that 2 months. Now he sees that you are using it in your game WITHOUT his permission. He will be angry. He may sue you.


Now, after that incident with Blizzard logo, I will always stay away from borrowing others work. I suggest that you should do it also.
